LIVELY, Senior Circuit Judge. The issue in this case is one of subject matter jurisdiction. The question is whether the amount in controversy in this diversity action exceeds $50,000, as required by 28 U.S.C. § 1332. Finding that the amount in controversy did not satisfy the statutory requirement at the inception of the action, we reverse the district courts judgment on the merits and remand with directions to dismiss.
